Terms of Use

1. Who we are

Boylu is provided by MelberLabs LLC, 30 N Gould St, Sheridan, WY 82801, USA ("MelberLabs", "we"). By installing or using Boylu you agree to these terms and to our Privacy Policy.

2. What Boylu is, and is not

Boylu offers a daily posture and stretching routine, an on-device posture check and a height and posture log. Boylu is not a medical device and does not provide medical advice, diagnosis or treatment. Posture scores and the "apparent height" figure are estimates derived from a single two-dimensional photo; they are not clinical measurements and individual results vary. Boylu does not promise any change in your body. If you have pain, an injury, a spinal condition, are pregnant or have any health concern, consult a doctor before starting and stop any move that hurts. You use the routines at your own risk and are responsible for exercising in a safe space.

3. Eligibility

You must be at least 16 years old. Advertising measurement is only offered to users aged 18 and over.

4. Account

An account is optional and only needed to sync your data across devices. You are responsible for keeping your credentials safe. You can delete your account at any time in Settings → Account; see our account deletion page.

5. Free features and Boylu Pro

The first three days of the program, one posture check, the last four measurements and desk mode are free. Boylu Pro is an auto-renewing subscription (weekly or yearly) purchased through the Apple App Store or Google Play. The price, period and any free trial are shown in the app before you buy, in your local currency.

• Payment is charged to your store account at confirmation of purchase, or at the end of the free trial if you do not cancel before it ends.
• The subscription renews automatically for the same period unless you cancel at least 24 hours before the end of the current period.
• You can manage or cancel the subscription in your App Store or Google Play account settings; deleting the app or your Boylu account does not cancel it.
• Refunds are handled by Apple or Google under their policies. Where consumer law gives you a right of withdrawal, you can exercise it through the store within 14 days, unless you asked for the service to start immediately and it has been fully provided.
• A free trial, where offered, is available once per store account.

6. Acceptable use

You may not reverse engineer the app, interfere with our servers, use automated means to access the service, or use Boylu to harm yourself or others. We may suspend accounts that abuse the service.

7. Intellectual property

The app, its routines, animations, voice recordings, texts and trademarks belong to MelberLabs or its licensors. We grant you a personal, non-transferable licence to use the app on devices you own. Content you enter (measurements, notes) remains yours; you grant us a licence to store and process it solely to provide the service.

8. Availability and changes

We may update, change or discontinue features. We aim for high availability but the service is provided "as is" and we do not promise uninterrupted operation. Your data stays on your device even when our servers are unavailable.

9. Liability

To the extent permitted by law, MelberLabs is not liable for indirect or consequential loss, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law, including mandatory consumer rights in your country of residence (for example under the Turkish Consumer Protection Law No. 6502 or the UK Consumer Rights Act 2015).

10. Termination

You can stop using Boylu and delete your account at any time. We may terminate accounts that breach these terms. Sections 2, 7, 9 and 11 survive termination.

11. Governing law

These terms are governed by the laws of the State of Wyoming, USA, without prejudice to mandatory consumer protection rules of the country where you live. Consumers in Türkiye may apply to consumer arbitration committees and consumer courts; consumers in the EU and UK may use their local courts.

1. Biz kimiz

Boylu, MelberLabs LLC (30 N Gould St, Sheridan, WY 82801, ABD; "MelberLabs", "biz") tarafından sunulur. Boylu'yu yükleyerek ya da kullanarak bu koşulları ve Gizlilik Politikası'nı kabul etmiş olursunuz.

2. Boylu nedir, ne değildir

Boylu günlük bir duruş ve esneme rutini, cihaz içi duruş kontrolü ve boy/duruş günlüğü sunar. Boylu tıbbi bir cihaz değildir; tıbbi tavsiye, teşhis ya da tedavi sağlamaz. Duruş puanı ve "görünür boy" değeri tek bir iki boyutlu fotoğraftan türetilen tahminlerdir; klinik ölçüm değildir ve kişiden kişiye değişir. Boylu vücudunuzda herhangi bir değişiklik vaat etmez. Ağrınız, yaralanmanız, omurga rahatsızlığınız varsa, hamileyseniz ya da herhangi bir sağlık endişeniz varsa başlamadan önce doktorunuza danışın ve acıtan her hareketi bırakın. Rutinleri kendi sorumluluğunuzla ve güvenli bir alanda uygularsınız.

3. Yaş sınırı

En az 16 yaşında olmalısınız. Reklam ölçümü yalnızca 18 yaş ve üzeri kullanıcılara teklif edilir.

4. Hesap

Hesap isteğe bağlıdır ve yalnızca verilerinizi cihazlar arasında taşımak için gerekir. Giriş bilgilerinizi korumak sizin sorumluluğunuzdadır. Hesabınızı istediğiniz zaman Ayarlar → Hesap'tan silebilirsiniz; bkz. hesap silme sayfası.

5. Ücretsiz özellikler ve Boylu Pro

Programın ilk üç günü, bir duruş kontrolü, son dört ölçüm ve masa başı modu ücretsizdir. Boylu Pro, Apple App Store ya da Google Play üzerinden satın alınan, otomatik yenilenen bir aboneliktir (haftalık ya da yıllık). Fiyat, dönem ve varsa ücretsiz deneme, satın almadan önce uygulamada yerel para biriminizle gösterilir.

• Ücret, satın alma onayında ya da ücretsiz deneme bitmeden iptal etmezseniz deneme sonunda mağaza hesabınızdan tahsil edilir.
• Abonelik, mevcut dönemin bitiminden en az 24 saat önce iptal edilmediği sürece aynı süreyle otomatik yenilenir.
• Aboneliği App Store ya da Google Play hesap ayarlarınızdan yönetebilir ve iptal edebilirsiniz; uygulamayı ya da Boylu hesabınızı silmek aboneliği iptal etmez.
• İadeler Apple ya da Google tarafından kendi politikalarına göre yapılır. Tüketici mevzuatı size cayma hakkı tanıyorsa bunu 14 gün içinde mağaza üzerinden kullanabilirsiniz; hizmetin hemen başlamasını istediyseniz ve hizmet tamamen sunulduysa bu hak uygulanmayabilir.
• Ücretsiz deneme, sunulduğu yerde mağaza hesabı başına bir kez kullanılabilir.

6. Kabul edilebilir kullanım

Uygulamayı tersine mühendislik yapamaz, sunucularımıza müdahale edemez, hizmete otomatik araçlarla erişemez ya da Boylu'yu kendinize ya da başkalarına zarar vermek için kullanamazsınız. Hizmeti kötüye kullanan hesapları askıya alabiliriz.

7. Fikri mülkiyet

Uygulama, rutinler, animasyonlar, ses kayıtları, metinler ve markalar MelberLabs'e ya da lisans verenlerine aittir. Size, sahip olduğunuz cihazlarda uygulamayı kullanmanız için kişisel ve devredilemez bir lisans veririz. Girdiğiniz içerik (ölçümler, notlar) size aittir; bize yalnızca hizmeti sunmak için bu içeriği saklama ve işleme lisansı verirsiniz.

8. Erişilebilirlik ve değişiklikler

Özellikleri güncelleyebilir, değiştirebilir ya da kaldırabiliriz. Yüksek erişilebilirlik hedefleriz ancak hizmet "olduğu gibi" sunulur ve kesintisiz çalışma taahhüt edilmez. Sunucularımız erişilemez olduğunda bile verileriniz cihazınızda kalır.

9. Sorumluluk

Yasaların izin verdiği ölçüde MelberLabs dolaylı ya da sonuç olarak ortaya çıkan zararlardan sorumlu değildir ve herhangi bir talep için toplam sorumluluğumuz, talepten önceki 12 ayda bize ödediğiniz tutarla sınırlıdır. Bu koşullardaki hiçbir hüküm, yasayla sınırlanamayan sorumlulukları ve ikamet ettiğiniz ülkedeki zorunlu tüketici haklarını (ör. 6502 sayılı Tüketicinin Korunması Hakkında Kanun) sınırlamaz.

10. Fesih

Boylu'yu kullanmayı istediğiniz zaman bırakabilir ve hesabınızı silebilirsiniz. Bu koşulları ihlal eden hesapları sonlandırabiliriz. 2, 7, 9 ve 11. bölümler fesihten sonra da geçerlidir.

11. Uygulanacak hukuk

Bu koşullar, yaşadığınız ülkenin zorunlu tüketici koruma kuralları saklı kalmak kaydıyla ABD Wyoming Eyaleti hukukuna tabidir. Türkiye'deki tüketiciler tüketici hakem heyetlerine ve tüketici mahkemelerine başvurabilir.
